Recommendations for incorporating a human rights-based approach in environmental impact assessment of mining projects

This research compares the different environmental impact assessment systems in the 10 National Human Rights Institutions (NHRIs) part of the Ibero-american Ombudsman Federation (FIO) Working Group on Human Rights and Business in Mining Contexts, as well as highlights best practices from the different NHRIs. These NHRI have outlined recommendations on: access to information, access to public participation and regarding free, prior and informed consent (FPIC). Moreover, these institutions have outlined recommendations for States and mining business on how to incorporate a human rights-based approach in EIA. The document also highlights the interdependence and interrelation amongst the different human rights, as environmental related human rights (rights to water, energy and a clean environment) are directly negatively impacted by the extractives industries, and thus put in jeopardy the communities’ livelihoods and cultural survival.
